Asset Investigations
If there is a necessity to quickly determine the asset position of a defendant, we have the capabilities to search out real property, bank accounts, and employment income. These services are provided to compliment our legal claims process and can be provided to clients on a per use basis on request.
Establish Contact
FCLS representatives undertake the opportunity to negotiate pre, during and post claim issuance. Our efforts are conducted to resolve an action prior to legal proceedings thereby reducing the costs and disbursements to our client.
Pre-Legal Demands
Pre-legal Demand Letters are available to clients who wish to make efforts to resolve disputes without resorting to the court process. Letters can either be purchased for a fee or they can be utilized as part of our legal claim process.
Recommend Solutions
There are a multitude of situations which do not warrant proceeding through a lengthy and costly legal process. It is our intentions to avoid court actions when we have the opportunity. Our representatives will where possible, provide alternate solutions to resolve a claim and will only accept when approved by our client.
Issue Claims
The first step to begin a lawsuit is the Plaintiff’s Claim where you state your pleadings. Our experienced staff will prepare your claim with careful consideration so that you have the best possible opportunity to obtain a judgment. All Plaintiffs claims request the entitlement to recover all or some of the costs associated with preparing, filing and serving a claim.
Process Service
Only Process Servicers are utilized to Serve Defendants with Statement of claims. Without affidavits of service, your claim cannot be moved to the next step.
Judgment Filing
According to the small claims court rules, a defendant has 20 days to file a defence. Where there is no defence filed or the court rules in your favour, we will immediately file and request judgment upon which a writ will be executed.
Asset Repossession
When assets are located, whether it be a car, boat, or house, we have the resources in place to locate and dispose of personal assets either by way of public auction or power of sale.
Settlement Negotiation
It is always the intentions to bring a solution of 100% to the table. In our experience, there are many situations whereby it may be advisable to accept less than the total for different reasons including but not limited to arrears, missed payments, debt load, asset position and available funds. These will be discussed and will be negotiated only with client approval.
Court Representation
Where a settlement conference or a trial is necessary, FCLS will provide expert representation to act as your advocate in the court of law. All of our representatives will be well versed in case laws pertinent to your specific claim in order to bring the best possible settlement to the claim.
